These Terms of Service ("Terms") govern your access to and use of the Augsentric platform and services ("Service"), operated by QnQ Consulting Pty Ltd (ABN 85 619 107 005), Suite 786, Shop 20, 130 High Street, Woodend, Victoria 3442, Australia ("we", "us", "our"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms. If you do not agree, do not access or use the Service.

2. Description of Service

Augsentric provides website analysis and monitoring tools that allow users to check and track various aspects of their websites, including performance, security, SEO metrics, uptime, and related signals. Features available to you depend on your subscription plan. We reserve the right to modify, add, or remove features at any time with reasonable notice where practical.

3. User Accounts

To access certain features of the Service you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your account credentials confidential and not share them with third parties
  • Notify us promptly at legal@augsentric.com if you suspect unauthorised access to your account
  • Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Billing, Subscriptions and Refunds

Augsentric offers the following subscription plans (all prices in Australian Dollars, AUD):

  • Starter (Free) - no charge, limited features
  • Pro - $19/month or $190/year
  • Premium - $79/month or $790/year

Payments. All paid plan payments are processed via Stripe. By subscribing to a paid plan, you authorise us to charge your nominated payment method on a recurring basis (monthly or annually, depending on the billing cycle you select). Prices are inclusive of GST where applicable.

Free trials. Pro and Premium plans may include a free trial period (14 days for Pro, 30 days for Premium). At the end of the trial, your payment method will be charged automatically unless you cancel before the trial ends.

Plan changes. You may upgrade or downgrade your plan at any time via your account settings. Upgrades take effect immediately and are prorated for the remainder of the current billing period. Downgrades take effect at the start of the next billing period.

Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you retain access to paid features until that date. No partial refunds are issued for the unused portion of a billing period on cancellation.

Refunds. Refund requests are handled on a case-by-case basis. To request a refund, contact us at legal@augsentric.com with details of your request. We will endeavour to respond within 5 business days.

5. Cookies

We use cookies and similar technologies to operate the Service. Essential cookies (including session, CSRF protection, theme preference, and consent state) are required for the Service to function and cannot be disabled. We also use optional analytics cookies via PostHog to understand how the Service is used; these are only set with your consent.

6. User Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Submit websites for analysis for which you do not have proper authorisation
  • Attempt to breach or circumvent any security or access controls
  • Use the Service to distribute malware or other harmful content
  • Interfere with or disrupt the Service or its underlying infrastructure
  • Scrape, reverse-engineer, or reproduce the Service or its outputs for resale or redistribution without our written consent
  • Engage in any activity that violates applicable laws or regulations

7. Data Retention and Deletion

We retain your data for periods that vary by subscription plan. For current retention limits, see the pricing page. Data associated with inactive or cancelled accounts is retained for a reasonable period to allow reactivation, after which it is deleted in accordance with our standard retention schedule.

You may request deletion of your personal data at any time by contacting us at legal@augsentric.com. Upon account deletion, we will remove your personal data within 30 days, subject to any legal obligations that require us to retain certain records.

8. Intellectual Property

The Service, including its design, software, trademarks, and content, is owned by or licensed to QnQ Consulting Pty Ltd. Nothing in these Terms transfers any ownership of the Service or its intellectual property to you.

You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, and use your data solely to the extent necessary to provide and improve the Service. We do not sell your data to third parties.

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results obtained from it will be accurate or reliable.

To the maximum extent permitted by applicable law, QnQ Consulting Pty Ltd shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Where liability cannot be excluded by law, our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

Either party may terminate the agreement formed by these Terms at any time. You may terminate by cancelling your subscription and ceasing to use the Service. We may suspend or terminate your access immediately if we have reasonable grounds to believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Service or other users.

Upon termination, your right to access the Service ends. Your data will be retained for the period described in Section 7, after which it will be deleted.

11. Modification of Terms

We may update these Terms from time to time. Where changes are material, we will provide reasonable notice - for example, by email or a prominent notice within the Service - before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms. The "Last Updated" date at the top of this page reflects the most recent revision.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. You and we submit to the exclusive jurisdiction of the courts of Victoria for the resolution of any dispute arising out of or in connection with these Terms or the Service.
